This article describes the Apple One-Year Limited Warranty for the U.S., Canada, Latin America and the Caribbean.
DISCUSSION WARRANTY COVERAGE Apple's warranty obligations are limited to the terms set forth below: Apple Computer, Inc. ("Apple") warrants this hardware product against defects in materials and workmanship for a period of ONE (1) YEAR from the date of original retail purchase. If a defect exists, at its option Apple will (1) repair the product at no charge, using new or refurbished replacement parts, (2) exchange the product with a product that is new or which has been manufactured from new or serviceable used parts and is at least functionally equivalent to the original product, or (3) refund the purchase price of the product. A replacement product assumes the remaining warranty of the original product or 90 days, whichever provides longer coverage for you. When a product or part is exchanged, any replacement item becomes your property and the replaced item becomes Apple's property. When a refund is given, your product becomes Apple's property. OBTAINING WARRANTY SERVICE For Hardware Products. If you have purchased your product in the U.S. or Canada, deliver the product, at your expense, to any Apple Authorized Service Provider located in U.S. or Canada. For US purchases, the repair area does NOT include US possessions, such as the US Virgin Islands, Guam, or Puerto Rico. If you have purchased your product in Latin America or the Caribbean, deliver the product to any Apple Authorized Service Provider in the country where you purchased the product. For Portable Hardware Products. ("Portable" is defined as any product that can operate independently without a power cord.) For portable products you may obtain service worldwide. Be aware, however, that not all countries have Apple Authorized Service Providers and not all Authorized Service Providers outside the country of purchase have all parts or replacement units for the product. If the product cannot be repaired or replaced in the country it is in, it may need to be sent to a different country or returned to the country of purchase at your expense for repair or replacement. To locate an Apple Authorized Service Provider call an Authorized Apple Reseller or visit our web site at http://www.apple.com/ . When you contact the Apple Authorized Service Provider, you will be asked to furnish your name, address, telephone number, and proof of the original purchase (receipt) containing a description of the product(s), purchase date, and the appropriate Apple serial number(s). In Latin America and the Caribbean you must obtain a warranty authorization form from your Authorized Reseller at the time of purchase to be eligible for warranty service. Note: Before you deliver your product for warranty service or, if applicable, make it available to a technician during on-site service, it is your responsibility to keep a separate backup copy of the system software, application software and data, and disable any security passwords. You will be responsible for reinstalling all such software, data and passwords. Data recovery is not included in the warranty service and Apple is not responsible for data that may be lost or damaged during transit or a repair. F or Selected Products. Some products may be eligible for On-Site or Express Mail/Courier Service within the United States and Canada. To determine if the product is eligible for either of these services, call an Apple Authorized Service Provider in the U.S., Canada, Latin America or the Caribbean, or call Apple directly at the telephone numbers set out in the service and support reference material accompanying the product. (a) On-Site Service. On-site service is the repair or replacement of the product at the product's location in the country of purchase, if it is within a 50-mile radius (in the U.S.), an 80-KM radius (in Canada), or a 50-KM radius (in Latin America or the Caribbean) of an Apple Authorized Service Provider. Outside these areas on-site service may either be unavailable or obtainable at extra charge. Apple and its Authorized Service Providers reserve the right to refuse on-site service at any location if, in the opinion of Apple or an Authorized Service Provider, performance of the service could jeopardize the safety of their personnel. In addition, you may be charged a fee under the following conditions: (1) the problem is found to result from the use of any non-Apple hardware product or any software product; or (2) no trouble with the Apple hardware product is found. (b) Express Mail in the U.S./Courier in Canada. Express mail/courier service involves mailing the product directly to Apple. If the product qualifies for this service, the telephone representative will provide further information and instructions. E XCLUSIONS AND LIMITATIONS This Apple Limited Hardware Warranty applies only to hardware products manufactured by or for Apple that can be identified by the "Apple" trademark, trade name, or logo affixed to them. Apple's Limited Hardware Warranty does not apply to any non-Apple hardware products or any software, even if packaged or sold with Apple hardware. Non-Apple manufacturers, suppliers, or publishers may provide their own warranties. Software distributed by Apple under the Apple brand name (including, but not limited to system software) is not covered under this Limited Hardware Warranty. Refer to the Apple Computer, Inc., Software License for more information. Apple and its Authorized Service Providers are not liable for any damage to or loss of any programs, data, or other information stored on any media, or any non-Apple product or part not covered by this warranty. Recovery and reinstallation of system and application software and user data are not covered under this Apple Limited Hardware Warranty. This warranty does not apply: (a) to damage caused by accident, abuse, misuse, misapplication, or non-Apple products; (b) to damage caused by service (including upgrades and expansions) performed by anyone who is not an Apple Authorized Service Provider; (c) to a product or a part that has been modified without the written permission of Apple; or (d) if any Apple serial number has been removed or defaced. THIS WARRANTY AND REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED. APPLE SPECIFICALLY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IF APPLE CANNOT LAWFULLY DISCLAIM IMPLIED WARRANTIES UNDER THIS LIMITED WARRANTY, ALL SUCH WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED IN DURATION TO THE DURATION OF THIS WARRANTY. No Apple reseller, agent, or employee is authorized to make any modification, extension, or addition to this warranty. APPLE IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOST PROFITS, DOWNTIME, GOODWILL, DAMAGE TO OR REPLACEMENT OF EQUIPMENT AND PROPERTY, ANY COSTS OF RECOVERING, REPROGRAMMING, OR REPRODUCING ANY PROGRAM OR DATA STORED IN OR USED WITH APPLE PRODUCTS, AND ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF DATA STORED ON THE PRODUCT. APPLE SPECIFICALLY DOES NOT REPRESENT THAT IT WILL BE ABLE TO REPAIR ANY PRODUCT UNDER THIS WARRANTY OR MAKE A PRODUCT EXCHANGE WITHOUT RISK TO OR LOSS OF PROGRAMS OR DATA. Some states and provinces do not allow the exclusion or limitation of incidental or consequential damages or exclusions or limitations on the duration of implied warranties or conditions, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and you may also have other rights that vary by state or province. |
